Terms and conditions
In short: We clean your site to the best of our ability and always take a backup before we start. A hacked plugin or theme may have to be removed or replaced, which sometimes affects features. We always tell you what we have done.
1. What these terms cover
These terms apply when you hire Sajtjouren to clean a hacked WordPress website. Your contracting party is Eric Sjöberg (sole trader, reg. no. 010624-3975), who runs Sajtjouren. The terms apply to both businesses and individuals. Anything that only applies to consumers is marked as such.
2. The service
We go through the website, remove malicious code, backdoors and unknown accounts, and replace modified files with clean originals. The package with hardening also includes hardening and monitoring as described on the website.
The inspection starts once you have sent the case. The cleanup itself only starts once you have approved our price.
3. What the cleanup involves
We undertake to do our best, not to achieve a particular result. We clean as well as we reasonably can using proven methods, but we do not guarantee that the website will be completely free of malicious code, will not be infected again, or will work exactly as before.
Cleaning a hacked website can break or change things. Infected or untrustworthy plugins, themes or custom code may have to be removed, disabled, replaced with clean versions or updated. Features, layout, integrations or content may then stop working or change. The more compromised the site, the more likely this is.
This is a normal consequence of the work, not a defect in the service, and gives no right to compensation or a price reduction. By hiring us you accept this.
Restoring things that stopped working, or rebuilding removed features, is not included. We are happy to help if you want, at €72 per hour excl. VAT, once you have agreed to it.
4. Packages and prices
| Package | Hours included | Price excl. VAT | Price incl. 25% VAT |
|---|---|---|---|
| Files only | 2 | €229 | €286 |
| Files + database | 3 | €365 | €456 |
| Files, database + hardening | 5 | €595 | €744 |
Businesses pay the prices excl. VAT. For individuals, the prices incl. 25% VAT apply.
Time beyond what is included costs €72 per hour excl. VAT (€90 incl. VAT). We always check with you before we go over the included hours.
5. If the site can't be saved
If the inspection shows that the website can't be saved, you only pay for the inspection: €72 excl. VAT.
6. Your responsibilities
- You confirm that you own the website or are authorised to give us access to it and to the hosting account.
- You give us the access we need and answer our questions.
- You are responsible for your own backups. We take a backup before we change anything, but it does not replace your own.
7. Login details
We treat login details as confidential, use them only for the job and do not keep them once the job is done. Change every password you gave us when we are finished.
8. Payment
We invoice once the website has been cleaned and we have verified the result, or once the inspection is done if the website cannot be saved. Payment terms are 10 days net. Late payments accrue interest under the Swedish Interest Act (räntelagen).
9. Liability
Our liability is limited to the amount you paid for the job. We are not liable for indirect loss, such as lost revenue, lost data or third-party claims.
Nor are we responsible for the website, its content, its function or its availability after the job.
These limitations do not apply in cases of gross negligence or intent. If you are a consumer, nothing in these terms limits your rights under mandatory consumer law.
10. Right of withdrawal for consumers
If you are a consumer, you have a 14-day right of withdrawal under the Swedish Distance Contracts Act (distansavtalslagen), counted from the day the contract is made.
By ticking the box in the form, you expressly ask us to start work straight away, before the withdrawal period has ended. If you withdraw, you pay for the work we have done up to that point.
The right of withdrawal ends when the service has been fully performed.
To withdraw, email hjalp@sajtjouren.com.
11. Personal data on your website (data processing agreement)
When we work on your website, we process personal data stored there, such as users, customers and comments. You are the controller and we are the processor. This section is our data processing agreement.
- We process the data only on your instructions and only to carry out the job. Which data and people are involved depends on what is on the website.
- We and everyone working for us are bound by confidentiality.
- We do not use the data for anything else and do not disclose it.
- We protect the data with appropriate technical and organisational measures.
- When the job is done, we delete our copies, including backups we took, unless the law requires us to keep them.
- A hack may be a personal data breach that you may have to report. We help you with the information you need and with answering the people concerned.
- We use sub-processors in the categories hosting, database and email. You approve them by hiring us.
- You may request the information needed to show that we comply with this section.
12. Disputes
Swedish law applies. If we disagree, we first try to resolve it together.
If you are a consumer, you can turn to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), arn.se. Otherwise disputes are settled by the general courts of Sweden.
13. Changes
We may change these terms. Your job is governed by the version you accepted when you sent the case. Send questions about the terms to hjalp@sajtjouren.com.
